The National Veteran Health Survey, a program of Blue Ridge Mountain Foundation, Inc. ("Foundation," "we," "us," or "our"), respects your privacy. This Privacy Policy explains how we collect, use, disclose, store, and protect information when you visit veteranhealthregistry.org. By using the Site, you consent to these practices. If you do not agree, do not use the Site.
By clicking any button labeled "Submit," "Complete," "I Agree," or by using this Site, you acknowledge and agree that your action constitutes an electronic signature as defined by the E-SIGN Act and the UETA. You intend to be legally bound by this Policy as if you had signed a physical document.
Voluntary Health Data: We collect military service details (unit, location) and health conditions. To protect identity, we use 3 year "buckets" for dates and age groups. We do not intentionally collect Names or Social Security Numbers.
Automatic Technical Data: We collect IP addresses, browser types, and session metadata for security, diagnostic, and performance purposes.
No Tracking Standard: We do not intentionally track individual identities, but we have no control over third party internet intermediaries involved in web traffic.
Prohibition of Re-Identification: Any attempt to "de-anonymize" or "re-identify" participants is strictly prohibited.
Prohibition of Scraping: Unauthorized automated data extraction is a violation of our Terms.
Liquidated Damages: Any "Bad Actor" (one who attempts re-identification or scraping) agrees to pay the Foundation liquidated damages of $50,000 per incident or $500 per record accessed, whichever is greater, plus legal fees.
Use of this Site is strictly prohibited where such use violates local or international law. If this Site is illegal in your jurisdiction, you do not have permission to use it. You must notify us immediately of any jurisdictional legal conflict via our contact form.
We use information to maintain the registry, generate advocacy reports, and prevent abuse. We reserve the right to utilize technical data, including, but not limited to, IP addresses, metadata, or any information obtainable through the normal use of the internet and available technologies, to identify, block, and prosecute "Bad Actors."
We may participate in affiliate programs and receive commissions for referrals. Interaction with third party sites is subject to their own privacy policies. We do not endorse third party services linked on the Site.
You agree to indemnify and hold harmless Blue Ridge Mountain Foundation, Inc. from any claims, losses, or liabilities arising from: (1) your use of the Site; (2) "Bad Actor" activity; (3) data breaches beyond our reasonable control; or (4) failure to notify us of jurisdictional legal conflicts.
Data on this site is for informational and advocacy purposes only. It is not medical or legal advice. We are not a government agency, and this survey does not constitute a formal VA claim.
The Foundation is not liable for service failures due to acts of God, natural disasters, or cyber attacks. We reserve the right to delete any data we deem fraudulent or malicious to maintain registry integrity.
Notice of Dispute: Before taking any formal legal action or filing any complaint, you must provide the Foundation with a written Notice of Dispute or Notice of Violation via our contact form.
30 Day Cure Period: You must give the Foundation 30 days from the receipt of your notice to investigate and, if necessary, "cure" or resolve the issue before you take any further action.
Mandatory Arbitration: If a dispute is not resolved within the 30 day cure period, you agree that the dispute shall be resolved through final and binding arbitration rather than in a court of law.
To the maximum extent permitted by law, the Foundation's total cumulative liability to you for any and all claims arising from your use of the Site or this Privacy Policy shall be limited to the total amount paid by you to the Foundation for the service or $100.00, whichever amount is lower.
Disputes will be conducted on an individual basis only, not as a class action. If any part of this Policy is found unenforceable, the remainder remains in full force.
This Policy shall be governed by and construed in accordance with the laws of the State of North Carolina. Any legal action or proceeding arising under this Policy shall be brought exclusively in the courts located in North Carolina.
Participant Data: De-identified health data is retained indefinitely for research.
Technical Logs: We do not intentionally retain user logs or metadata beyond what is necessary to ensure security and prosecute "Bad Actors." We periodically purge logs that are no longer required for investigative or security purposes.
The Foundation utilizes third party datasets (such as CDC/NHANES) for context. We do not warrant that these external datasets are error-free or current. Comparative results are for advocacy purposes and are not definitive medical conclusions.
This Privacy Policy constitutes the entire agreement between you and the Foundation regarding the subject matter herein and supersedes all prior or contemporaneous communications, whether electronic, oral, or written.
